In Portugal, the capital gain resulting from the sale of a property is subject to IRS, being considered a category G (asset increases). The taxable amount is calculated as the difference between the sale value and the acquisition value, and certain associated expenses can be deducted. However, the sale of a permanent home can be exempt from this tax if the proceeds are reinvested in the purchase of another permanent home.
In Portugal, for exemption from capital gains tax on the sale of a home, the sale proceeds must be reinvested in another home within 36 months of the sale. If the reinvestment is not total, the tax will be charged on the uninvested portion. If the new home is bought within 24 months of the sale of the previous home, the sale proceeds must be used to pay off the loan on the new home.
